Walsall Council left three potholes on Syned Hall Road only filled in half way across. The reason being that the other half was judged to be on Housing Association land. "If we had repaired the pothole on the Walsall Housing Group we could have been liable should an incident subsequently have occurred," says the Council's Traffic and Transportation Manager Glyn Oliver.

I suppose there could be such a theoretical legal risk. Common sense suggests it is infinitesmally small. Council officers who preocuppy themselves with such matters show completely the wrong attitude. Sometimes the risk averseness borders on a phobia. Instead of constantly watching their backs they should be given clear instructions to serve the interests of local residents who pay their salaries.
